Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Terms and Conditions of Purchase at any time. You will be subject to the policies and Terms and Conditions of Purchase in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Learning Tutor Limited is a leading group of experienced Teachers and Education Management Professionals fully qualified to teach in the UK. We have excellent OfSTED observations in addition to high examination success rates. We believe in individual needs and tailoring our learning solutions to suit each learner's requirement. We offer various tutoring packages for individuals and groups. Our tutors are available in person or on-line. For schools and educational establishments we offer a range of bespoke services. Learning Tutor Limited also publishes resources for students and teachers of Mathematics, Business Studies, ICT, Science and related subjects. We offer a large selection of free revision material via the Learning Tutor Limited website (www.LearningTutor.co.uk) and a wide range of subscription-based resources. Learning Tutor Limited also operates a comprehensive programme of revision seminars (workshops) and teacher CPD events - please contact us for further details.
Making A Purchase
Making a purchase is simple and secure. We use PayPal for on-line transactions to ensure you have additional buyer protection and peace of mind.
Personal or non-School customers should pay for their order using PayPal. When you are ready to checkout, click on "Order" and PayPal will handle all payment details. When complete, we will be notifed by PayPal and will then send process your order.
You will receive a confirmation of your order from Learning Tutor Limited once it has been received and a payment confirmation from PayPal if appropriate.
Schools and Colleges can take advantage of our "Invoice with Order" payment option. Please note that our payment terms are 14 days from receipt of goods. Please ensure that you quote our full invoice reference number on all remittance advices.
Schools and Colleges should note that Learning Tutor Limited reserves the right to exercise our legal right to claim interest on amounts that remain overdue beyond our standard payment terms of 14 days from receipt of goods. In line with UK law, interest on overdue invoices will be calculated daily at the Bank of England base rate plus 8 per cent.
Our contract
If you place an order online to purchase a product from LearningTutor.co.uk we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we deliver the product to you. Any products on the same order which we have not delivered to you do not form part of that contract. You warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.
Description of the Goods
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.
Availability
The supply of goods from this website is subject to availability and it is not always possible for us to inform you at the time you place your order whether the goods you want are still available for purchase. In the case of this happening a carefully selected alternative may be sent, or a refund may be given.
Cancellation and Returns - Tangible Products
We offer a 21-day no quibbles returns policy, which begins from the date you received the goods. If you contact us outside of the 21-day period we will not refund the order (unless defective/damaged). All unwanted goods should be returned in a resaleable condition. This does not affect your statutory rights.
For more information on your statutory rights please visit http://www.consumerdirect.gov.uk/. Please note that Digital Downloads and Courses are subject to different terms of sale and a shorter 14-day returns period.
When you send your item back to us we will process the returned item and offer you the choice of a replacement (excluding second hand goods, which are unique) or a refund.
If you request a refund we will refund the full price of the goods, including any mandatory delivery charges incurred. Please be aware that any voluntary delivery contribution that is made is a charitable donation and will not constitute a delivery cost capable of being refunded.
You will receive notification via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase.

Shipping And Handling
All items may be purchased via PayPal and include FREE delivery (please allow 2-5 days for delivery). However, from time to time we may offer products that have postal charges and for these we shall prior to checkout, add a postage charge will be to your invoice based on the product you wish to order. We ship all products via First or Second Class Mail.
We aim to ship all orders within two working days of receiving them. Please allow 2-5 days for delivery. Do contact us if there is a problem with your delivery, we thrive to provide an excellent service however we are realistic about postal problems and will try to assist if there is a third party issue i.e. delivery problem via Royal Mail.
Pre-orders / Advanced Orders:
In some cases, you may have ordered goods or services which have a publication or event date at a future date. For example, many of our study guides are published 2-3 weeks after the exam case study is issued, or we may allow advanced ordering of new resources to enable schools to utilise their current year budgets. Advanced orders for places on our revision workshops and teacher conferences are also permitted.
In the case of pre-orders or advanced bookings, we will not send out the relevant invoice until either the goods have been shipped or places at events have been confirmed.
Delivery Schedule
We will endeavour to deliver your order within 48 hours following confirmation of receipt of payment (or purchase order for schools and colleges using the "Invoice with Order" payment option). We send all resources by Royal Mail / Post Office. We send you the material on a CD-ROM. All Learning Tutor Limited materials are published in PDF format. You will need a recent version of the free Adobe Reader (download from www.adobe.com) to be able to view these files.
Tax Charges
ALL of our products and services are VAT exempt.
*PLEASE NOTE: We are currently in the process of registering for VAT. Learning Tutor Limited products are all standard-rated. VAT at the prevailing rate will be added to your invoice and shown seperately at the shopping cart stage. All prices are published exclude value added tax (VAT). VAT is payable regardless of the Delegate’s country of origin; the point of supply for VAT purpose is the location of the course. The published prices do not include any travel, accommodation or living expenses which the delegates may incur in attending unless specifically mentioned on the training booking agreement. All pricing quotations are valid only for 7 days from the date they are first sent to the Customer.

Privacy Policy
Learning Tutor Limited does not disclose buyers' information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. Data collected by this site is used to:
a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes
Please note that we do not retain financial details provided by customers on this web site. Payment processing is all provided by secure third parties.
Returns Policy
Due to the nature of our digital resources, we do not normally offer any refunds for materials purchased from us. Our materials are not sold with digital rights protection - you are able to use them straightaway without password protection. Each of our digital learning has a sample, extract, preview or detailed description supplied online via our web site (or via other promotional materials) which clearly describes the content and purpose of each item. This gives you - the customer - a clear understanding of what you are purchasing.
However, if you are unhappy with the content of your Learning Tutor Limited resources, please let us know why and we will do all that is reasonable to meet your requirements. If you have received damaged merchandise such as a faulty CD-ROM, then we will ship another CD Free of charge. Where appropriate, we will also arrange a refund of your purchase.
We will endeavour to arrange the appropriate refund or return within 7 working days of the matter being notified to us.
This returns policy does not affect your statutory rights. Nor are your statutory rights affected for all tangible products bought through our Learner-Shop/Store.
Remittance Terms:
For schools and colleges that use our "Invoice with Order" option, our payment terms are 14 days from receipt of invoice. Please ensure that our full invoice number is included in all remittances.
Cancellation of Orders are based on the type of product or service we have included the 'Cancellation period end' for each type of contract please see each section applicapble to the product or service:
A service contract: 14 days after the day on which the contract was made

We reserve the right to take legal action against any party or parties found to have breached our copyright. Damages and other remedies are available to us in respect of copyright infringements.

Payments for Courses, Seminars, Workshops or Training:
The course fees, including VAT, are payable 20 working days before course start date. Customers wishing to make payments made from non UK accounts or credit cards must be responsible for all bank charges in relation to the overseas transaction; this includes charges levied by the customer’s bank and that levied by the bank of Learning Tutor Limited, in accepting this specific transaction.
Any late payments will be subject to a late payment charge at the rate of 5% over the Bank of England base rate. Payments can be made by major credit and debit cards including American Express.
Where a Purchase Order is issued must clearly state the purchase order number, course dates, full Invoice amount and contact details for invoicing. When more than one course is booked on the same booking form, full payment for all courses, including VAT, is required 20 working days before the commencement of the first course.
Where the relevant invoice has not been paid by course start date then we have the right to refuse the delegate(s) entry to the course. In these circumstances, the invoice in question will remain payable in full. We reserve the right to withhold examination results and certificates until all payments have been made. Administration fee for cancellations are payable immediately upon invoice. The Terms of this agreement override over any other terms of business or purchase conditions put forward by the Customer.
Once a payment has been made, may it be a deposit or full payment, over the phone or on the website by the following methods: Debit Card, Credit Card, American Express, the delegate is adhering to Learning Tutor Limited's terms and conditions irrespective if a booking form has been signed. In addition, if payment has also been received via bank transfer or cheque the delegate is adhering to Learning Tutor Limited terms and conditions irrespective if a booking form has been signed.
Purchase Order/ identification number:
If a purchase order is provided there is no need for any other confirmation (i.e. booking forms to be signed). The purchase order constitutes as a legal offer to buy products or services. The Purchase Order is deemed as a confirmation of an order and is bound by the cancellation & re-scheduling policy set out in this document.
Cancellation for website orders:
All orders placed through the company’s websites are non cancellable and non refundable.
Cancellations non website orders:
Unless written cancellation is received at least 20 working days before the start date of the course, the fees including VAT are payable in full and non refundable. All cancellations made between 0-20 working days to the course start date are subject to a 100% cancellation fee payable immediately upon cancellation. Notification of all cancellations must be made in writing via email.
Should a course booking be made less than 20 working days in advance of the start date of the course, the above cancellation terms still apply and fees are payable in full and non refundable.
If the cancellation is more than 20 working days in advance of the course a charge of £50 + VAT per delegate will be payable upon cancellation. Cancelling specialist courses more than 20 working days will incur a charge of £250+VAT. For all courses that have a fee of less than £200, then this will incur a 100% cancellation cost.
Once a payment has been made, may it be a deposit or full payment, over the phone by the following methods: Debit Card, Credit Card, American Express, the delegate is adhering to Learning Tutor Limited's terms and conditions irrespective if a booking form has been signed. In addition, if payment has also been received via bank transfer or cheque the delegate is adhering to Learning Tutor Limited terms and conditions irrespective if a booking form has been signed.
Re-scheduling courses or exams:
Rescheduling courses or exams less than 20 working days of the course start date is not permitted and therefore will incur a 100% rescheduling fee. Rescheduling courses or exams more than 20 working days of the course start date will incur a £199+VAT charge.(per change) payable immediately upon rescheduling. Rescheduling of specialist courses more than 20 working days will incur a charge of £299+VAT
Refunds:
In the case where a refund is made to the Customer by Learning Tutor Limited, the refund may take up to 30 working days to be processed. Refunds will be processed using the same payment method that the original payment was made. All deposits are non-refundable, upon payment of your deposit you are contracted to pay the confirmed course fee at the time of booking, and Learning Tutor Limited reserve the right to change prices at any time at their discretion. Upon payment of a deposit, the delegate is adhering to Learning Tutor Limited terms and conditions. Refunds will be made in GBP (£) for the exact amount originally received, less any cancellation or pre course fees that may be payable. Learning Tutor Limited will not be liable for any fluctuation in exchange rates or bank charges for overseas refund transactions.
Under all circumstances course examination voucher purchases are non-refundable. This includes purchases where a change of course schedule has taken place (Please see Changes to Courses for more details)
Deferring of Practitioner Examinations:
Upon commencement of the training course, Learning Tutor Limited accepts that occasionally an individual delegate may wish to for personal reasons; defer a practitioner examination to a later date. In this case, the delegate will be subject to a rescheduled exam fee of £299 + VAT and must reschedule the examination within 20 working days of the original exam date, subject to availability. We do not allow the deferral of foundation examinations. Delegates must inform Learning Tutor Limited of the deferral at least 24hours in advance of the original exam time.
Changes to Courses:
Learning Tutor Limited reserves the right to change any part of a published course; if this is caused by circumstances beyond our control. Learning Tutor Limited reserve the right to cancel or reschedule any course and will advise the customer as soon as the change is known. Learning Tutor Limited will use all reasonable endeavours to avoid changes of this nature. For any courses which are rescheduled due to unforeseen circumstances such as trainer sickness/course low fill every endeavour will be made to provide a replacement trainer or to reschedule the course and we will offer delegates as many options as possible to complete their training programme. However for these unforeseen circumstances refunds will not be granted. Contents of course timetables are intended for general guidance only. Any typographical error or omission in any website, sales literature, administrative documentation, course materials, invoice or other document shall be liable to correction without any liability on the part of Learning Tutor Limited. The Location and course date of the course will be advised upon booking. Learning Tutor Limited reserve the right to change the location and will advise the customer as soon as the change is known. Learning Tutor Limited will not be liable for out of pocket expenses due to cancellation or any other changes to venue or programme.
Course Materials:
If for any reason (including but not limited to transit delays beyond the control of Learning Tutor Limited) courseware does not arrive on time for the course we will commit to replacing it at the earliest opportunity and make best endeavours to make temporary materials accessible as required to continue the learning program. Refunds will not be granted for transit related delays beyond the control of Learning Tutor Limited.
Non Attendance:
Non-attendance of any course for any reason whatsoever is deemed to be a cancellation with no notice and payment is due in full.
Course Suitability:
The Customer accepts that it is their responsibility that the course booked is suitable for the requirements and abilities of the delegates attending. Learning Tutor Limited's employees may recommend courses or learning solutions, however, the assessment and the final decision concerning suitability of the course is the Customer's responsibility. In cases where we have made recommendations, we do so in good faith and will not be willfully misleading. All public and onsite training courses are delivered only in English and all Delegates must be sufficiently proficient in the English language before attending the course.
Admission:
Learning Tutor Limited reserves the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for whatsoever reason. If individuals are found to enquire (by phone, email or website), book ( including making payment), or attend our training classes in person, further legal action will be taken against both the individual and/or their respective companies and no refund will be granted.
Booking on behalf of the Delegate:
In all cases the customer undertakes to bring these terms and conditions to the attention of delegates. It is the customer’s responsibility to ensure that the delegates receive all the relevant information including the joining instructions and that they meet the eligibility and published prerequisite requirements.
Onsite Training on Client Specified Site:
It is the Customer’s responsibility to provide all facilities, equipment and set up required for trainer to deliver the training. Learning Tutor Limited reserves the right to cancel or discontinue the course if, in the Trainer's opinion, the venue, equipment or conditions are unsuitable.
Trainer Expenses:
Trainer expenses for private, onsite or closed courses will be charged as agreed at the time of the course booking, as stated on the Training Booking Agreement.
Shipping:
Additional charges will be incurred for shipping of pre-course work or certificates to locations outside of the UK. All certificates provided are digital copies, and further copies (digital or hard copy) will incur an admin fee. Further additional certificate charges could be incurred if a certificate is not reported missing within 6 weeks. Please contact your learning advisor for further information.
Copyrights:
All intellectual property rights for all course materials shall remain the property of Learning Tutor Limited. The Customer agrees not to reproduce, sell, hire, lend or copy the course materials or use them except for the purpose of personal reference. Learning Tutor Limited warrants that it will not knowingly include any copyright material in its course materials without license or consent.
Warranty & Liability:
Learning Tutor Limited liability for loss and damage shall be limited to a claim for damages. The maximum aggregate liability will be the charges for the course out of which the loss or damage has arisen. Learning Tutor Limited will not accept liability for death or personal injury. Learning Tutor Limited will not be liable for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss. Learning Tutor Limited will not be responsible for any damage resulting from any computer viruses arising from software installed on customer computer systems.
Multiple Course Booking or Part Attendance of a Course:
A multiple course booking is when more than one course is confirmed that may make up part of a certification e.g. Business Diploma, etc. Part attendance of a Course is when a delegate does not continue to the full course completion. In this situation the delegate will not be entitled to any refund for courses or part of course that were not attended, this will be deemed as non-attendance.
Personal Belongings:
Personal belonging or items belonging to the Delegate on the Delegate’s possessions brought onto training courses are the sole responsibility of the Delegate. Learning Tutor Limited accept no responsibility of the items or any loss or damage that may occur during the course.
E-Learning/Online Learning:
Course enrolment, fees and logon credentials are strictly non transferable and non refundable. Fair Usage Policy applies to access to study materials. Learning Tutor Limited reserve the right to restrict access based on operational requirements including bandwidth consumption to ensure fair access to all learners. Access to e-learning/online products is granted for a 90 day period.
Extensions can be granted upon request so please contact enquiries@learningtutor.co.uk to obtain an extension quotation. Whilst Learning Tutor Limited endeavours to ensure that the information on the online platform is correct, we do not warrant the accuracy and completeness of the materials on the site and we make changes to the e-learning/online content from time to time without notice. Learning Tutor Limited reserves the right to change or alter course content from that which is published in order to maintain the quality of the learning. All e-learning examinations are valid for 12 months from date of purchase.
Non Solicitation:
For 12 months following either the invoice date or the date of course delivery, of any contract carried out for the Customer by Learning Tutor Limited or an associate company of Learning Tutor Limited, the Customer, will not directly nor indirectly employ or solicit for employment any employee of Learning Tutor Limited. If the Customer breaches this clause, Learning Tutor Limited shall be entitled to recover from the Customer a fee of 50% of the gross annual salary of the employee of Learning Tutor Limited solicited for employment.
Assignments:
Learning Tutor Limited may assign its interests in all or part of this agreement. The customer may not assign or transfer this contract without the express written permission of a Director of Learning Tutor Limited.
Deviation:
No deviation from these terms and conditions will be allowed without the express written permission of a Director of Learning Tutor Limited. No communication either verbal or printed on our websites will override these Terms and Conditions. If in any case any of these conditions shall be held to be invalid or shall not apply, the contract and the other conditions shall remain in force and effect.
Force Majeure:
Learning Tutor Limited shall not be in breach of this contract if the provision of services are delayed or cancelled or reduced through any circumstances beyond it's reasonable control including acts of God (including but not limited to, fire, flood, earthquake, storm, snow, hurricane or other natural disaster) sickness, war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. Delegates must ensure that they can attend the training courses which they are scheduled to attend. Learning Tutor Limited will not be held liable, financially or actually, for their non-attendance, whatsoever the reason may be.
Privacy Policy:
Learning Tutor Limited is committed to maintaining your privacy and the use of your personal information. If at any stage you have a question regarding the personal information that we hold on file, please do not hesitate to contact us.
Learning Tutor Limited will not disclose personal information to a third party organisation unless we have your prior consent to provide this or you have opted to allow the use of your personal information. If the request for your personal information is for a legal purpose, this we would class as an exception, but only after we have 100% fully verified the name or organization requesting your personal details. This also applies to a third party training partner who is not contractually obliged to use or sell your personal information with any other companies or partners.
Learning Tutor Limited at no stage will disclose personal credit card account information that is voluntarily provided during a transaction process, may this be by telephone or via our secure web-portal. The exception to this would be if Learning Tutor Limited were to make contact with the credit card company for validation or verification of any transaction process purpose. Learning Tutor Limited does not have total control of how your personal information can be used by credit card companies but we would request they inform Learning Tutor Limited on how they may use this information.
It is our commitment not to collect personal information from customers visiting our web site unless they have voluntarily submitted their personal information via one of our contact forms that requires information which could be based on an enquiry or to book onto a training course. If you start to complete a contact enquiry form and decide not to finish, partial details are stored from which Learning Tutor Limited may use this information to make contact with you, only to discuss your initial enquiry which was started but not finished. From time to time, Learning Tutor Limited may contact you to inform you about a specific training program that is related to your original enquiry, request or training course.
IP addresses may be seen by Learning Tutor Limited and on some occasions the providers host name but this information will not disclose your identity.
Learning Tutor Limited will not take photographs, videos or any audio recordings of you during a course and will not use this material for Learning Tutor Limited’s own marketing purpose without your prior consent. Delegates are not permitted to take any video/photography/audio during the course without prior written consent of Learning Tutor Limited and its clients, failure to do so will be considered a direct breach of our terms of business and this matter would be taken very seriously.
Security and Encryption:
We use the highest level of security and encryption methods available for processing payments online. We also strictly adhere to best practices of data protection and PCI compliance. That means your payment details are as secure as they possibly can be when making a purchase with us.
Intellectual Property:
The website and all the products and services of Learning Tutor Limited without limitation are protected by international copyrights, trademarks and subject to intellectual property rights. Therefore all intellectual property belongs to Learning Tutor Limited, its related companies, its affiliates or suppliers. You may not copy, sell, reproduce, distribute, download, modify, display or prepare derivative works based on, repost, transmit or otherwise use any of the intellectual property of this site. The information on this site is provided “as is” and without any warranties. Learning Tutor Limited does not accept responsibility of content of any third party sites that maybe referenced by Learning Tutor Limited LearningTutor.co.uk. The following activities are strictly prohibited: use of robots, other automatic device or manual process to monitor or copy the site of any of its content or the replication of this site to any server. Audio or video recording of courses is not permitted.
Losses
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss even if the loss was reasonably foreseeable to both you and us when you commenced using the website or when the contract for the sale of goods was formed. However, Learning Tutor Limited does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.
Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Your obligation to LearningTutor.co.uk / Learning Tutor Limited:
You agree that you will only use learningtutor.co.uk in a manner that is consistent with these user conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use learningtutor.co.uk to transmit or post any material which is defamatory, offensive, or of an obscene or menacing character, or which may, in our judgement, cause annoyance, inconvenience or anxiety to any person. To the extent to which your use, or the use by any person who may be authorised by you or for whom you are responsible (for example as an employer or as the parent or guardian of a child) causes loss or damage to any person, you agree to indemnify tutor2u immediately on demand in relation to any such losses or damages attributable to learningtutor.co.uk, including where necessary any legal and administrative, or technical charges that may arise from such use.
You agree that the material and content contained within or provided by learningtutor.co.uk is for your use only and may not be distributed commercially without our permission. You may not display the contents of learningtutor.co.uk in a frame surrounded by other material not originated by us. Your use of the learningtutor.co.uk carries with it no rights in relation to copyright, trade marks or other intellectual property rights that belong to learningtutor.co.uk . The learningtutor.co.uk logo and learningtutor.co.uk name are trade marks of Learning Tutor Limited.

Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Terms and Conditions of Purchase at any time. You will be subject to the policies and Terms and Conditions of Purchase in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Learning Tutor Limited is a leading group of experienced Teachers and Education Management Professionals fully qualified to teach in the UK. We have excellent OfSTED observations in addition to high examination success rates. We believe in individual needs and tailoring our learning solutions to suit each learner's requirement. We offer various tutoring packages for individuals and groups. Our tutors are available in person or on-line. For schools and educational establishments we offer a range of bespoke services. Learning Tutor Limited also publishes resources for students and teachers of Mathematics, Business Studies, ICT, Science and related subjects. We offer a large selection of free revision material via the Learning Tutor Limited website (www.LearningTutor.co.uk) and a wide range of subscription-based resources. Making A Purchase
Making a purchase is simple and secure. We use PayPal for on-line transactions to ensure you have additional buyer protection and peace of mind.
Personal or non-School customers should pay for their order using PayPal. When you are ready to checkout, click on "Order" and PayPal will handle all payment details. When complete, we will be notifed by PayPal and will then send process your order.
You will receive a confirmation of your order from Learning Tutor Limited once it has been received and a payment confirmation from PayPal if appropriate.
Schools and Colleges can take advantage of our "Invoice with Order" payment option. Please note that our payment terms are 14 days from receipt of goods. Please ensure that you quote our full invoice reference number on all remittance advices.
Schools and Colleges should note that Learning Tutor Limited reserves the right to exercise our legal right to claim interest on amounts that remain overdue beyond our standard payment terms of 14 days from receipt of goods. In line with UK law, interest on overdue invoices will be calculated daily at the Bank of England base rate plus 8 per cent.
Our contract
If you place an order online to purchase a product from LearningTutor.co.uk we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we deliver the product to you. Any products on the same order which we have not delivered to you do not form part of that contract. You warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.
Description of the Goods
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.
Availability
The supply of goods from this website is subject to availability and it is not always possible for us to inform you at the time you place your order whether the goods you want are still available for purchase. In the case of this happening a carefully selected alternative may be sent, or a refund may be given.
Cancellation and Returns - Tangible Products
We offer a 21-day no quibbles returns policy, which begins from the date you received the goods. If you contact us outside of the 21-day period we will not refund the order (unless defective/damaged). All unwanted goods should be returned in a resaleable condition. This does not affect your statutory rights.

When you send your item back to us we will process the returned item and offer you the choice of a replacement (excluding second hand goods, which are unique) or a refund.
If you request a refund we will refund the full price of the goods, including any mandatory delivery charges incurred. Please be aware that any voluntary delivery contribution that is made is a charitable donation and will not constitute a delivery cost capable of being refunded.
You will receive notification via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase.

Shipping And Handling
All items may be purchased via PayPal and include FREE delivery (please allow 2-5 days for delivery). However, from time to time we may offer products that have postal charges and for these we shall prior to checkout, add a postage charge will be to your invoice based on the product you wish to order. We ship all products via First or Second Class Mail.
We aim to ship all orders within two working days of receiving them. Please allow 2-5 days for delivery. Do contact us if there is a problem with your delivery, we thrive to provide an excellent service however we are realistic about postal problems and will try to assist if there is a third party issue i.e. delivery problem via Royal Mail.
Pre-orders / Advanced Orders:
In some cases, you may have ordered goods or services which have a publication or event date at a future date. For example, many of our study guides are published 2-3 weeks after the exam case study is issued, or we may allow advanced ordering of new resources to enable schools to utilise their current year budgets. Advanced orders for places on our revision workshops and teacher conferences are also permitted.
In the case of pre-orders or advanced bookings, we will not send out the relevant invoice until either the goods have been shipped or places at events have been confirmed.
Delivery Schedule
We will endeavour to deliver your order within 48 hours following confirmation of receipt of payment (or purchase order for schools and colleges using the "Invoice with Order" payment option). We send all resources by Royal Mail / Post Office. We send you the material on a CD-ROM. All Learning Tutor Limited materials are published in PDF format. You will need a recent version of the free Adobe Reader (download from www.adobe.com) to be able to view these files.
Tax Charges
ALL of our products and services are VAT exempt.
*PLEASE NOTE: We are currently in the process of registering for VAT. Learning Tutor Limited products are all standard-rated. VAT at the prevailing rate will be added to your invoice and shown seperately at the shopping cart stage. All prices are published exclude value added tax (VAT). VAT is payable regardless of the Delegate’s country of origin; the point of supply for VAT purpose is the location of the course. The published prices do not include any travel, accommodation or living expenses which the delegates may incur in attending unless specifically mentioned on the training booking agreement. All pricing quotations are valid only for 7 days from the date they are first sent to the Customer.

Learning Tutor Limited does not disclose buyers' information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. Data collected by this site is used to:

b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes
Please note that we do not retain financial details provided by customers on this web site. Payment processing is all provided by secure third parties.
Returns Policy
Due to the nature of our digital resources, we do not normally offer any refunds for materials purchased from us. Our materials are not sold with digital rights protection - you are able to use them straightaway without password protection. Each of our digital learning has a sample, extract, preview or detailed description supplied online via our web site (or via other promotional materials) which clearly describes the content and purpose of each item. This gives you - the customer - a clear understanding of what you are purchasing.
However, if you are unhappy with the content of your Learning Tutor Limited resources, please let us know why and we will do all that is reasonable to meet your requirements. If you have received damaged merchandise such as a faulty CD-ROM, then we will ship another CD Free of charge. Where appropriate, we will also arrange a refund of your purchase.
We will endeavour to arrange the appropriate refund or return within 7 working days of the matter being notified to us.
This returns policy does not affect your statutory rights. Nor are your statutory rights affected for all tangible products bought through our Learner-Shop/Store.
Remittance Terms:
For schools and colleges that use our "Invoice with Order" option, our payment terms are 14 days from receipt of invoice. Please ensure that our full invoice number is included in all remittances.
Cancellation of Orders are based on the type of product or service we have included the 'Cancellation period end' for each type of contract please see each section applicapble to the product or service:

Payments for Courses, Seminars, Workshops or Training:
The course fees, including VAT, are payable 20 working days before course start date. Customers wishing to make payments made from non UK accounts or credit cards must be responsible for all bank charges in relation to the overseas transaction; this includes charges levied by the customer’s bank and that levied by the bank of Learning Tutor Limited, in accepting this specific transaction.
Any late payments will be subject to a late payment charge at the rate of 5% over the Bank of England base rate. Payments can be made by major credit and debit cards including American Express.
Where a Purchase Order is issued must clearly state the purchase order number, course dates, full Invoice amount and contact details for invoicing. When more than one course is booked on the same booking form, full payment for all courses, including VAT, is required 20 working days before the commencement of the first course.
Where the relevant invoice has not been paid by course start date then we have the right to refuse the delegate(s) entry to the course. In these circumstances, the invoice in question will remain payable in full. We reserve the right to withhold examination results and certificates until all payments have been made. Administration fee for cancellations are payable immediately upon invoice. The Terms of this agreement override over any other terms of business or purchase conditions put forward by the Customer.
Once a payment has been made, may it be a deposit or full payment, over the phone or on the website by the following methods: Debit Card, Credit Card, American Express, the delegate is adhering to Learning Tutor Limited's terms and conditions irrespective if a booking form has been signed. In addition, if payment has also been received via bank transfer or cheque the delegate is adhering to Learning Tutor Limited terms and conditions irrespective if a booking form has been signed.
Purchase Order/ identification number:
If a purchase order is provided there is no need for any other confirmation (i.e. booking forms to be signed). The purchase order constitutes as a legal offer to buy products or services. The Purchase Order is deemed as a confirmation of an order and is bound by the cancellation & re-scheduling policy set out in this document.
Cancellation for website orders:
All orders placed through the company’s websites are non cancellable and non refundable.
Cancellations non website orders:
Unless written cancellation is received at least 20 working days before the start date of the course, the fees including VAT are payable in full and non refundable. All cancellations made between 0-20 working days to the course start date are subject to a 100% cancellation fee payable immediately upon cancellation. Notification of all cancellations must be made in writing via email.
Should a course booking be made less than 20 working days in advance of the start date of the course, the above cancellation terms still apply and fees are payable in full and non refundable.
If the cancellation is more than 20 working days in advance of the course a charge of £50 + VAT per delegate will be payable upon cancellation. Cancelling specialist courses more than 20 working days will incur a charge of £250+VAT. For all courses that have a fee of less than £200, then this will incur a 100% cancellation cost.
Once a payment has been made, may it be a deposit or full payment, over the phone by the following methods: Debit Card, Credit Card, American Express, the delegate is adhering to Learning Tutor Limited's terms and conditions irrespective if a booking form has been signed. In addition, if payment has also been received via bank transfer or cheque the delegate is adhering to Learning Tutor Limited terms and conditions irrespective if a booking form has been signed.
Re-scheduling courses or exams:
Rescheduling courses or exams less than 20 working days of the course start date is not permitted and therefore will incur a 100% rescheduling fee. Rescheduling courses or exams more than 20 working days of the course start date will incur a £199+VAT charge.(per change) payable immediately upon rescheduling. Rescheduling of specialist courses more than 20 working days will incur a charge of £299+VAT
Refunds:
In the case where a refund is made to the Customer by Learning Tutor Limited, the refund may take up to 30 working days to be processed. Refunds will be processed using the same payment method that the original payment was made. All deposits are non-refundable, upon payment of your deposit you are contracted to pay the confirmed course fee at the time of booking, and Learning Tutor Limited reserve the right to change prices at any time at their discretion. Upon payment of a deposit, the delegate is adhering to Learning Tutor Limited terms and conditions. Refunds will be made in GBP (£) for the exact amount originally received, less any cancellation or pre course fees that may be payable. Learning Tutor Limited will not be liable for any fluctuation in exchange rates or bank charges for overseas refund transactions.
Under all circumstances course examination voucher purchases are non-refundable. This includes purchases where a change of course schedule has taken place (Please see Changes to Courses for more details)
Deferring of Practitioner Examinations:
Upon commencement of the training course, Learning Tutor Limited accepts that occasionally an individual delegate may wish to for personal reasons; defer a practitioner examination to a later date. In this case, the delegate will be subject to a rescheduled exam fee of £299 + VAT and must reschedule the examination within 20 working days of the original exam date, subject to availability. We do not allow the deferral of foundation examinations. Delegates must inform Learning Tutor Limited of the deferral at least 24hours in advance of the original exam time.
Changes to Courses:
Learning Tutor Limited reserves the right to change any part of a published course; if this is caused by circumstances beyond our control. Learning Tutor Limited reserve the right to cancel or reschedule any course and will advise the customer as soon as the change is known. Learning Tutor Limited will use all reasonable endeavours to avoid changes of this nature. For any courses which are rescheduled due to unforeseen circumstances such as trainer sickness/course low fill every endeavour will be made to provide a replacement trainer or to reschedule the course and we will offer delegates as many options as possible to complete their training programme. However for these unforeseen circumstances refunds will not be granted. Contents of course timetables are intended for general guidance only. Any typographical error or omission in any website, sales literature, administrative documentation, course materials, invoice or other document shall be liable to correction without any liability on the part of Learning Tutor Limited. The Location and course date of the course will be advised upon booking. Learning Tutor Limited reserve the right to change the location and will advise the customer as soon as the change is known. Learning Tutor Limited will not be liable for out of pocket expenses due to cancellation or any other changes to venue or programme.
Course Materials:
If for any reason (including but not limited to transit delays beyond the control of Learning Tutor Limited) courseware does not arrive on time for the course we will commit to replacing it at the earliest opportunity and make best endeavours to make temporary materials accessible as required to continue the learning program. Refunds will not be granted for transit related delays beyond the control of Learning Tutor Limited.
Non Attendance:
Non-attendance of any course for any reason whatsoever is deemed to be a cancellation with no notice and payment is due in full.
Course Suitability:
The Customer accepts that it is their responsibility that the course booked is suitable for the requirements and abilities of the delegates attending. Learning Tutor Limited's employees may recommend courses or learning solutions, however, the assessment and the final decision concerning suitability of the course is the Customer's responsibility. In cases where we have made recommendations, we do so in good faith and will not be willfully misleading. All public and onsite training courses are delivered only in English and all Delegates must be sufficiently proficient in the English language before attending the course.
Admission:
Learning Tutor Limited reserves the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for whatsoever reason. If individuals are found to enquire (by phone, email or website), book ( including making payment), or attend our training classes in person, further legal action will be taken against both the individual and/or their respective companies and no refund will be granted.
Booking on behalf of the Delegate:
In all cases the customer undertakes to bring these terms and conditions to the attention of delegates. It is the customer’s responsibility to ensure that the delegates receive all the relevant information including the joining instructions and that they meet the eligibility and published prerequisite requirements.
Onsite Training on Client Specified Site:
It is the Customer’s responsibility to provide all facilities, equipment and set up required for trainer to deliver the training. Learning Tutor Limited reserves the right to cancel or discontinue the course if, in the Trainer's opinion, the venue, equipment or conditions are unsuitable.
Trainer Expenses:
Trainer expenses for private, onsite or closed courses will be charged as agreed at the time of the course booking, as stated on the Training Booking Agreement.
Shipping:
Additional charges will be incurred for shipping of pre-course work or certificates to locations outside of the UK. All certificates provided are digital copies, and further copies (digital or hard copy) will incur an admin fee. Further additional certificate charges could be incurred if a certificate is not reported missing within 6 weeks. Please contact your learning advisor for further information.
Copyrights:
All intellectual property rights for all course materials shall remain the property of Learning Tutor Limited. The Customer agrees not to reproduce, sell, hire, lend or copy the course materials or use them except for the purpose of personal reference. Learning Tutor Limited warrants that it will not knowingly include any copyright material in its course materials without license or consent.
Warranty & Liability:
Learning Tutor Limited liability for loss and damage shall be limited to a claim for damages. The maximum aggregate liability will be the charges for the course out of which the loss or damage has arisen. Learning Tutor Limited will not accept liability for death or personal injury. Learning Tutor Limited will not be liable for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss. Learning Tutor Limited will not be responsible for any damage resulting from any computer viruses arising from software installed on customer computer systems.
Multiple Course Booking or Part Attendance of a Course:
A multiple course booking is when more than one course is confirmed that may make up part of a certification e.g. Business Diploma, etc. Part attendance of a Course is when a delegate does not continue to the full course completion. In this situation the delegate will not be entitled to any refund for courses or part of course that were not attended, this will be deemed as non-attendance.
Personal Belongings:
Personal belonging or items belonging to the Delegate on the Delegate’s possessions brought onto training courses are the sole responsibility of the Delegate. Learning Tutor Limited accept no responsibility of the items or any loss or damage that may occur during the course.
E-Learning/Online Learning:
Course enrolment, fees and logon credentials are strictly non transferable and non refundable. Fair Usage Policy applies to access to study materials. Learning Tutor Limited reserve the right to restrict access based on operational requirements including bandwidth consumption to ensure fair access to all learners. Access to e-learning/online products is granted for a 90 day period.
Extensions can be granted upon request so please contact enquiries@learningtutor.co.uk to obtain an extension quotation. Whilst Learning Tutor Limited endeavours to ensure that the information on the online platform is correct, we do not warrant the accuracy and completeness of the materials on the site and we make changes to the e-learning/online content from time to time without notice. Learning Tutor Limited reserves the right to change or alter course content from that which is published in order to maintain the quality of the learning. All e-learning examinations are valid for 12 months from date of purchase.
Non Solicitation:
For 12 months following either the invoice date or the date of course delivery, of any contract carried out for the Customer by Learning Tutor Limited or an associate company of Learning Tutor Limited, the Customer, will not directly nor indirectly employ or solicit for employment any employee of Learning Tutor Limited. If the Customer breaches this clause, Learning Tutor Limited shall be entitled to recover from the Customer a fee of 50% of the gross annual salary of the employee of Learning Tutor Limited solicited for employment.
Assignments:
Learning Tutor Limited may assign its interests in all or part of this agreement. The customer may not assign or transfer this contract without the express written permission of a Director of Learning Tutor Limited.
Deviation:
No deviation from these terms and conditions will be allowed without the express written permission of a Director of Learning Tutor Limited. No communication either verbal or printed on our websites will override these Terms and Conditions. If in any case any of these conditions shall be held to be invalid or shall not apply, the contract and the other conditions shall remain in force and effect.
Force Majeure:
Learning Tutor Limited shall not be in breach of this contract if the provision of services are delayed or cancelled or reduced through any circumstances beyond it's reasonable control including acts of God (including but not limited to, fire, flood, earthquake, storm, snow, hurricane or other natural disaster) sickness, war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. Delegates must ensure that they can attend the training courses which they are scheduled to attend. Learning Tutor Limited will not be held liable, financially or actually, for their non-attendance, whatsoever the reason may be.
Privacy Policy:
Learning Tutor Limited is committed to maintaining your privacy and the use of your personal information. If at any stage you have a question regarding the personal information that we hold on file, please do not hesitate to contact us.
Learning Tutor Limited will not disclose personal information to a third party organisation unless we have your prior consent to provide this or you have opted to allow the use of your personal information. If the request for your personal information is for a legal purpose, this we would class as an exception, but only after we have 100% fully verified the name or organization requesting your personal details. This also applies to a third party training partner who is not contractually obliged to use or sell your personal information with any other companies or partners.
Learning Tutor Limited at no stage will disclose personal credit card account information that is voluntarily provided during a transaction process, may this be by telephone or via our secure web-portal. The exception to this would be if Learning Tutor Limited were to make contact with the credit card company for validation or verification of any transaction process purpose. Learning Tutor Limited does not have total control of how your personal information can be used by credit card companies but we would request they inform Learning Tutor Limited on how they may use this information.
It is our commitment not to collect personal information from customers visiting our web site unless they have voluntarily submitted their personal information via one of our contact forms that requires information which could be based on an enquiry or to book onto a training course. If you start to complete a contact enquiry form and decide not to finish, partial details are stored from which Learning Tutor Limited may use this information to make contact with you, only to discuss your initial enquiry which was started but not finished. From time to time, Learning Tutor Limited may contact you to inform you about a specific training program that is related to your original enquiry, request or training course.
IP addresses may be seen by Learning Tutor Limited and on some occasions the providers host name but this information will not disclose your identity.
Learning Tutor Limited will not take photographs, videos or any audio recordings of you during a course and will not use this material for Learning Tutor Limited’s own marketing purpose without your prior consent. Delegates are not permitted to take any video/photography/audio during the course without prior written consent of Learning Tutor Limited and its clients, failure to do so will be considered a direct breach of our terms of business and this matter would be taken very seriously.
Security and Encryption:
We use the highest level of security and encryption methods available for processing payments online. We also strictly adhere to best practices of data protection and PCI compliance. That means your payment details are as secure as they possibly can be when making a purchase with us.
Intellectual Property:
The website and all the products and services of Learning Tutor Limited without limitation are protected by international copyrights, trademarks and subject to intellectual property rights. Therefore all intellectual property belongs to Learning Tutor Limited, its related companies, its affiliates or suppliers. You may not copy, sell, reproduce, distribute, download, modify, display or prepare derivative works based on, repost, transmit or otherwise use any of the intellectual property of this site. The information on this site is provided “as is” and without any warranties. Learning Tutor Limited does not accept responsibility of content of any third party sites that maybe referenced by Learning Tutor Limited LearningTutor.co.uk. The following activities are strictly prohibited: use of robots, other automatic device or manual process to monitor or copy the site of any of its content or the replication of this site to any server. Audio or video recording of courses is not permitted.
Losses
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss even if the loss was reasonably foreseeable to both you and us when you commenced using the website or when the contract for the sale of goods was formed. However, Learning Tutor Limited does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.
Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Your obligation to LearningTutor.co.uk / Learning Tutor Limited:
You agree that you will only use learningtutor.co.uk in a manner that is consistent with these user conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use learningtutor.co.uk to transmit or post any material which is defamatory, offensive, or of an obscene or menacing character, or which may, in our judgement, cause annoyance, inconvenience or anxiety to any person. To the extent to which your use, or the use by any person who may be authorised by you or for whom you are responsible (for example as an employer or as the parent or guardian of a child) causes loss or damage to any person, you agree to indemnify tutor2u immediately on demand in relation to any such losses or damages attributable to learningtutor.co.uk, including where necessary any legal and administrative, or technical charges that may arise from such use.
You agree that the material and content contained within or provided by learningtutor.co.uk is for your use only and may not be distributed commercially without our permission. You may not display the contents of learningtutor.co.uk in a frame surrounded by other material not originated by us.
